Terms of service

1. Scope
These Terms and Conditions apply to all orders placed via our online shop.

2. Contracting party, conclusion of contract
The purchase contract is concluded with SaleLab GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by e-mail.

3. Contract language, storage of the contract text
The language available for the conclusion of the contract is German.
We do not store the text of the contract.

4. Delivery terms
In addition to the stated product prices, shipping costs will be charged. Further information on the amount of the shipping costs can be found in the offers.

We deliver goods by shipping only. Unfortunately, self-collection of the goods is not possible.

We do not deliver to parcel lockers (Packstationen).

5. Payment

The following payment methods are generally available in our shop:

Credit card
By placing the order, you transmit your credit card details to us at the same time.
After your legitimisation as the rightful cardholder, we will request your credit card company to initiate the payment transaction immediately after the order. The payment transaction will be carried out automatically by the credit card company and your card will be charged.

PayPal, PayPal Express 

During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, log in with your access data and confirm the payment instruction to us. After placing the order in the shop, we will request PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. Further information will be provided during the ordering process.

SOFORT bank transfer

After placing the order, you will be redirected to the website of the online provider SOFORT bank transfer. In order to pay the invoice amount via SOFORT bank transfer, you must have an online banking account activated for participation in SOFORT bank transfer with PIN/TAN procedure, legitimise yourself accordingly and confirm the payment instruction to us. Further information will be provided during the ordering process. The payment transaction will be carried out by SOFORT bank transfer immediately afterwards and your account will be debited.

Amazon Pay

During the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to process the ordering process via Amazon and pay the invoice amount, you must be registered there or register first and legitimise yourself with your access data. There you can choose the delivery address and payment method stored with Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online shop where you can complete the ordering process.

Immediately after placing the order, we will request Amazon to initiate the payment transaction. The payment transaction will be carried out automatically by Amazon. Further information will be provided during the ordering process.


6. Retention of title
The goods remain our property until full payment has been made.

7. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurer.

8. Warranty and guarantees
Unless expressly agreed otherwise below, the statutory liability for defects shall apply.

The limitation period for claims for defects for used goods is one year from delivery of the goods.

The above limitations and reductions of time limits shall not apply to claims for damages caused by us, our legal representatives or vicarious agents in the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty and fraud, in the event of breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
within the scope of a guarantee promise, insofar as agreed, or
insofar as the scope of application of the German Product Liability Act (Produkthaftungsgesetz) is opened.

9. Liability
We shall always be liable without limitation for claims for damages caused by us, our legal representatives or vicarious agents
in the event of injury to life, body or health,
in the event of intentional or grossly negligent breach of duty,
in the event of a guarantee promise, insofar as agreed, or insofar as the scope of application of the German Product Liability Act (Produkthaftungsgesetz) is opened.

In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives or vicarious agents, our liability shall be limited in amount to the damage foreseeable at the time the contract was concluded and which must typically be expected to occur. Otherwise, claims for damages are excluded.


10. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here http://ec.europa.eu/consumers/odr/. 
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

You are not 100% satisfied with our pamo? If you are not satisfied within 100 days, simply send the product back and we will refund your full investment. Please send your product including packaging as a parcel to the address designated for your country (return shipping costs are borne by the buyer):

12. Terms and conditions for competitions and prize draws

 

12.1.1 Subject matter of the terms and conditions for participation in a competition run by “pamo.” on Instagram/Facebook

(1)     These terms and conditions govern the conditions for participation in a competition organised by “pamo.” and, where applicable, the transfer of rights required. The description and the process of the respective competition take place within the scope of the respective competition campaign / raffles on the Facebook page of pamo., the Instagram page pamo.design or the Pinterest page pamo.

(2)     The organiser of the competition is SaleLab GmbH, Haydnstraße 28, 88284 Wolperstwende

(3)     By participating in the respective competition, these terms and conditions are accepted.

(4)     The competition is not connected with Facebook, Instagram or Pinterest and is not sponsored, supported or organised by Facebook, Instagram or Pinterest.

 

12.1.2 Participation in the pamo. competition

(1)     All persons who have reached the age of 18 and have their place of residence in Germany, Austria, Switzerland or another European country are eligible to participate in the competition. Participation is not limited to customers of the organiser.

(2) Employees of SaleLab GmbH as well as affiliated companies and relatives of such employees and their relatives are excluded. Participation with fake identities or identities of third parties is not permitted. In addition, the organiser reserves the right, at its sole discretion, to exclude persons from participation if there are justified reasons, for example

(a) in the event of manipulation in connection with access to or the conduct of the competition, (b) in the event of violations of these terms and conditions, (c) in the event of unfair conduct or (d) in the event of false or misleading information in connection with participation in the competition.

(3)     Eligible participants can take part in the competition by liking the competition post (“Like” click) and keeping this rating at least until the winners are selected. In addition, the account of “pamo.” should be followed on the respective platform (Instagram, Facebook, Pinterest).

(4)     Participation is free of charge and valid online only during the period specified in the post.

 

12.1.3 Prizes and winner notification

(1)     Among all eligible participants, we will raffle off a previously mentioned pamo. product or a voucher for a pamo. product.

(2)     The winners will be selected at random within one week after the end of the participation period among all eligible participants.

The winners will be notified via the Facebook/Instagram/Pinterest comment function or in a separate post and asked to send an e-mail to an e-mail address provided there in which the personal data are transmitted completely, correctly and truthfully. This information is used to send the prize.

(3)     If no e-mail is received from a winner within one week or if the winner does not respond to a contact request, the claim to the prize expires. In this case, we are entitled to conduct a replacement draw.

(4)     The prize will be handed over exclusively to the winner. An exchange, self-collection or cash payment of the prize is not possible.

 (5)     If circumstances arise for which the organiser is not responsible, the respective winner shall accept an appropriate substitute prize. Such circumstances for which the organiser is not responsible are in particular those that lie with the sponsors of the prizes. 

(6)     The prizes will be sent to the winner by post to the address provided. We are not responsible for delivery damage.

 

12.1.4 Exclusion

(1)     A violation of these terms and conditions entitles us to exclude the respective participant from participation. This applies in particular if the participant makes false statements or if photos or other content used (e.g. comments) violate applicable law or rights of third parties. The same applies to comments that can be regarded as glorifying violence, offensive, harassing or degrading or that otherwise violate common decency. 

(2)     If the excluded participant is a winner who has already been drawn, the prize can be subsequently revoked.

 

12.1.5 Early termination and changes

We reserve the right to terminate the competition at any time, even without observing deadlines, in whole or in part, or to change it in the course of its execution, if it is not possible to guarantee proper implementation for technical reasons (e.g. computer virus, manipulation or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook).

12.1.6 Data protection

We are responsible for the collection, processing and use of participants' personal data insofar as we process them ourselves. We will use the participant's personal data and other personal data only within the scope of the statutory provisions of data protection law. We will store, process and use the information only insofar as this is necessary for the implementation of the competition or if the participant has given consent. This also includes use for exercising the granted rights of use. The data will be used exclusively for the implementation of the competition and will then be deleted.

The participant may request information at any time about the data stored about him/her. Otherwise, our privacy policy shall apply accordingly, which can be accessed at https://pamo-design.de/pages/impressum-datenschutz.

 

12.1.7 Final provisions

(1)     Should the terms and conditions contain invalid provisions, the validity of the conditions shall remain unaffected in all other respects.

(2)    The competition of the organiser is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

(3) Questions or complaints in connection with the competition are to be addressed to the organiser. Contact options can be found in the imprint area of the pamo. website or the SaleLab GmbH website.

(1)     Among all eligible participants, we will refund the purchase price of the product shown in the previously uploaded image to one participant. The maximum refund is €1,000 in product value.

(2)     The winners will be determined within two weeks after the end of the respective monthly participation period among all eligible participants by internal voting.

The winners will be notified by e-mail to the e-mail address provided with the upload and asked to send an e-mail with the personal order number of the product shown to us, in which the personal data are transmitted completely, correctly and truthfully. This information is used to verify the prize.

(3)     If no e-mail is received from a winner within two weeks or if the winner does not respond to a contact request, the claim to the prize expires. In this case, we are entitled to conduct a replacement draw.

(4)     The refund of the prize will be made exclusively to the winner and to the original payment method used. An exchange, self-collection or cash payment of the prize is not possible.

(5)     The prizes will be refunded to the winner within four weeks.

By participating in the competition you grant us and our partners a non-exclusive, free of charge, unlimited in time and territory right to use your UGC for all marketing purposes, online and offline, in particular in advertising, e.g. in catalogues, in-store, e-mails and other communications both towards entrepreneurs and consumers, in particular to store, reproduce, display, distribute, make publicly accessible and—subject to Section 14 of the German Copyright Act (Urhebergesetz)—to modify and edit your UGC (“Licence”).

The Licence is:

  • “non-exclusive”, i.e. you may use your UGC for your own purposes and you may allow others to use your UGC for their purposes;
  • “free of charge”, i.e. without remuneration. We owe you nothing in connection with the use of your UGC;
  • “unlimited in time”, i.e. you grant us the licence for an indefinite period of time;
  • “unlimited in territory”, i.e. we may exercise the licence anywhere in the world.

Our “partners” are exclusively our partner shops, resellers and affiliated companies within the meaning of Section 15 of the German Stock Corporation Act (Aktiengesetz) as well as "Cevoid AB".

YOU REPRESENT AND WARRANT TO US

  • that you have the right to grant us the licence to the extent described above;
  • that you have obtained permission from all persons depicted in your UGC that the UGC in which they are depicted may be used to the extent described above;
  • that you have fully paid any licence fees or other remuneration that may be related to your UGC;
  • that your UGC does not infringe any rights of third parties, e.g. intellectual property or personal rights;
  • that you are a natural person who has reached the age of eighteen (18), or that you as legal guardian agree to the licence to the extent described above.

We reserve the right to discontinue the use of your UGC at any time and without notice and to remove it from our marketing channels without replacement.

 

12.2.8 Final provisions

(1)     Should the terms and conditions contain invalid provisions, the validity of the conditions shall remain unaffected in all other respects.

13. Campaign "Bread Friday"

Here we promise to donate 20% of the revenue generated from clothing rails in the online shop on Friday, “Black Friday”, 29.11.2019, to Welthungerhilfe. SaleLab GmbH cannot decide how Welthungerhilfe uses the donation money. The information for calculating school meals in Africa is only an example calculation, which is also provided by Welthungerhilfe.

 

14. Right of withdrawal

The statutory right of withdrawal exists exclusively for consumers within the meaning of Section 13 of the German Civil Code (BGB). Entrepreneurs within the meaning of Section 14 BGB who act in the course of their commercial or self-employed professional activity when concluding the contract do not have a statutory right of withdrawal.
